  2. SOUTH DAKOTA MORTGAGE

  4. This mortgage made ______________, 19___, by Miranda M. Mortgagor,
  5. of 1234 56th Avenue Northwest, City  of Fogartyville, County of
  6. Lollapalooza, State of South Dakota, Mortgagor, to Fifth National
  7. Bank, of  2345 67th Avenue Southeast, City of Fogartyville, County
  8. of Lollapalooza, State of South Dakota, Mortgagee.

  10. Witnesseth, that mortgagor hereby mortgages to mortgagee the 
  11. following described premises situated in the County of
  12. Lollapalooza,  State of South Dakota:

  14. (see exhibit 1)

  16. as security for the payment to mortgagee at Fogartyville, South
  17. Dakota of the principal  sum of $123,456.78 ( one hundred twenty
  18. three thousand four hundred fifty six & 78/100 dollars) and
  19. interest thereon at 11.1% per  annum from date, according to that
  20. certain promissory note  bearing even date herewith, due
  21. September 10, 2024.

  23. Mortgagor further agrees to pay all taxes and assessments that 
  24. may be levied on the premises, before the same shall become 
  25. delinquent, and to keep the buildings, if any, on the premises 
  26. safely insured for the benefit of mortgagee in the sum of
  27. $123,456.78   ( one hundred twenty three thousand four hundred
  28. fifty six & 78/100 dollars) against loss by fire and deliver the
  29. insurance  policies to mortgagee.

  31. In case of mortgagor's failure to pay such taxes or assessments 
  32. before the same become delinquent or to pay insurance premiums 
  33. for insurance on such buildings, mortgagee, or an assignee may do 
  34. so, and the amount so paid, with interest at 12.2% from the date 
  35. of payment, shall be added to and deemed a part of the money 
  36. secured by this mortgage. Mortgagor hereby relinquishes 
  37. mortgagor's rights of homestead in the premises and warrants that 
  38. mortgagor is the owner in fee of the premises, and that the same 
  39. are free from all encumbrances.

  41. In case of default in the payment of such principal sum of money 
  42. or any part thereof, or interest thereon, at the time or times 
  43. above specified for payment thereof, or in case of nonpayment of 
  44. any taxes, assessments, or insurance as aforesaid, or of breach 
  45. of any covenant or agreement herein contained, then and in either 
  46. case, the whole principal and interest of such note shall at the 
  47. option of the holder thereof immediately become due and payable, 
  48. and this mortgage may be foreclosed by action or by advertisement 
  49. as provided by statue or the rules of practice relating thereto, 
  50. and this paragraph shall be deemed as authorizing and 
  51. constituting a power of sale as mentioned in such statues or 
  52. rules any amendatory thereof.
